What does it take to get UO to update its AA plan?

12/30/2009. State law requires a response in 7 days. The DOJ will bill UO about $1000 ($137 per hour) for writing a careful, annotated response to this petition. Apparently Melinda Grier would prefer paying this to just forwarding along the draft – or just being straight about why UO is, once again, unable to update its Affirmative Action Plan on time.

Dear Attorney General Kroger:

This is a petition asking you to order University of Oregon Affirmative Action Director Penny Daugherty to provide a copy of the current working draft of UO’s “2009-2010” Affirmative Action plan.

I requested a copy of this from Ms. Daugherty on 12/21. She had previously told me that an updated AA plan was in progress and that she expected it would be available on the web by the end of November. It was not, and at that point she stopped responding to my questions about when it would be posted.

She has also not responded to my questions about why she has delayed sending the requested draft, which is surely on her computer or that of one of her staff, and which could be emailed to me with a few mouse clicks.

I ask for a fee waiver on the basis of public interest. Many UO departments are now entering the hiring season and UO does not have a current, valid AA plan in place, despite federal regulations which require this and despite Ms Daugherty’s 2007 agreement with the Office of Federal Contract Compliance Programs that she would comply with this rule. Ms Daugherty’s previous failures to update UO’s AA plan in accord with federal rules have been the subject of a series of news stories, including the attached. UO’s most recent plan is dated “effective Jan 1 2008.”
